California v. Johnson & Johnson
Johnson & Johnson, Ethicon, Inc., and Ethicon US, LLC (collectively, Ethicon) appealed after a trial court levied nearly $344 million in civil penalties against Ethicon for willfully circulating misleading medical device instructions and marketing communications that misstated, minimized, and/or omitted the health risks of Ethicon’s surgically-implantable transvaginal pelvic mesh products. The court found Ethicon committed 153,351 violations of the Unfair Competition Law (UCL), and 121,844 violations of the False Advertising Law (FAL). The court imposed a $1,250 civil penalty for each violation. The Court of Appeal concluded the trial court erred in just one respect: in addition to penalizing Ethicon for its medical device instructions and printed marketing communications, the court penalized Ethicon for its oral marketing communications, specifically, for deceptive statements Ethicon purportedly made during one-on-one conversations with doctors, at Ethicon-sponsored lunch events, and at health fair events. However, there was no evidence of what Ethicon’s employees and agents actually said in any of these oral marketing communications. Therefore, the Court of Appeal concluded substantial evidence did not support the trial court’s factual finding that Ethicon’s oral marketing communications were likely to deceive doctors. Rodriguez v. FCA US, LLC
The Song-Beverly Consumer Warranty Act (also known as California’s “Lemon Law”) defined “new motor vehicle” as a new vehicle purchased primarily for personal (nonbusiness) purposes, but also specified that the term included “a dealer-owned vehicle and a ‘demonstrator’ or other motor vehicle sold with a manufacturer’s new car warranty.” The remedy at issue here, known as the “refund-or-replace” provision, required a manufacturer to replace a defective “new motor vehicle” or make restitution if, after a reasonable number of attempts, the manufacturer (or its representative) was unable to repair the vehicle to conform to the applicable express warranty. Plaintiffs Everardo Rodriguez and Judith Arellano purchased a two-year-old Dodge truck from a used car dealership. The truck had over 55,000 miles on it and, though the manufacturer’s basic warranty had expired, the limited powertrain warranty had not. After experiencing electrical defects with the truck, plaintiffs sued the manufacturer, FCA US, LLC (Chrysler), for violation of the refund-or-replace provision. FCA moved for summary judgment, arguing the truck was not a “new motor vehicle,” and the trial judge agreed. The sole issue in this case was whether the phrase “other motor vehicle sold with a manufacturer’s new car warranty” covered sales of previously owned vehicles with some balance remaining on the manufacturer’s express warranty. The Court of Appeal concluded it did not, and that the phrase functioned instead as a catchall for sales of essentially new vehicles where the applicable warranty was issued with the sale. California v. Alorica, Inc.
This case arose from an ongoing investigation by the district attorneys’ offices of several California counties into the debt collection practices of Alorica Inc. (Alorica), specifically the Rosenthal Fair Debt Collection Practices Act, and the federal Telephone Consumer Protection Act. In November 2019, the district attorneys' offices (collectively referred to as the State) served Alorica with an investigative subpoena. The subpoena contained 11 separate document requests and covered the time period from February 2015 through the date the subpoena was served. The State directed Alorica to respond by December 13, 2019, and to specify whether any of the requested records were no longer in Alorica’s “possession, custody or control.” Alorica served its objections and responses to the subpoena. Alorica objected to most of the requests, and argued that the requests violated Alorica’s right to privacy and right against unreasonable searches and seizures. Alorica claimed that it did not have any debt collection clients, so it denied having any of the requested agreements with clients related to debt collection, policies and procedures relating to the collection of consumer debt, or call records of debt collection calls as to the defined top five clients. One year later, in November 2020, the People petitioned for an order compelling full compliance with the subpoena. Alorica opposed and argued that it was not a debt collector subject to the Rosenthal Act, so the subpoena was invalid as it was not reasonably relevant to an investigation concerning debt collection. DeNike v. Mathew Enterprise, Inc.
In 2014, DeNike purchased a 2014 hardtop Jeep Wrangler from SCJ. DeNike subsequently discovered that, contrary to a salesman’s representation, the vehicle was originally manufactured as a soft top. The hardtop was improperly installed after it left the factory. DeNike filed suit. A jury found in favor of DeNike on his claims under the Consumers Legal Remedies Act (CLRA) (Civ. Code 1750 ), the Song-Beverly Consumer Warranty Act (section 1790), and for intentional misrepresentation. The trial court issued a permanent injunction against SCJ and, in a post-judgment order, awarded DeNike attorney fees.The court of appeal reversed with respect to restitution under the CLRA. Having found that SCJ’s response to DeNike’s CLRA demand letter was “reasonable and appropriate,” the trial court erred in allowing DeNike’s claim for restitution under the CLRA to proceed to the jury. The court rejected arguments that there was insufficient evidence of reasonable reliance to support the verdict on the intentional misrepresentation cause of action and that the trial court misinstructed the jury on the Song-Beverly Act cause of action and erred in granting DeNike’s request for injunctive relief under the CLRA. Lee v. Amazon.com, Inc.
California’s 1986 Safe Drinking Water and Toxic Enforcement Act, Health & Saf. Code 25249.5, Proposition 65, provides that no business shall "knowingly and intentionally expose any individual to a chemical known to the state to cause cancer or reproductive toxicity without first giving clear and reasonable warning.” Mercury compounds are listed as Proposition 65 reproductive toxins. Cosmetics containing 0.0001 percent or more of mercury are prohibited under federal law, 21 U.S.C. 331(a)–(c). Lee alleged skin-lightening creams offered for sale on Amazon’s Web site sold by third parties, contain mercury.The trial court concluded that Amazon is immune from liability under the federal Communications Decency Act (CDA), 47 U.S.C. 230, and that Lee failed to establish elements required by Proposition 65. The court of appeal reversed. The stated reasons for concluding that a laboratory test finding a high level of mercury in one unit of a skin-lightening cream is an insufficient basis for inferring other units of the same product contain mercury do not withstand scrutiny. The trial court erred in ruling that Lee was required to prove Amazon had actual knowledge the products contained mercury and in excluding evidence of constructive knowledge. The negligent failure to warn claim did not seek to hold a website owner liable as the “publisher or speaker of any information provided by another information content provider,” so CDA did not bar the claim. Anderson v. Ford Motor Co.
In October 2004, plaintiff Shelby Anderson (individually, plaintiff) and his wife, plaintiff Tammy Anderson (Tammy), bought a Ford Super Duty F-250 6.0 liter diesel pickup truck containing an engine sourced from nonparty ITEC, also known as Navistar (Navistar). Plaintiff chose the Ford for its power, towing capacity, and other qualities as represented by defendant Ford Motor Company (Ford) in brochures and advertisements and by Ford dealership sales agents. Plaintiff began experiencing issues with the truck during his second year of ownership. After numerous attempts to have the vehicle repaired so it could perform the functions for which they purchased it, plaintiffs effectively gave up, rendering the truck a “driveway ornament.” After opting out as putative members of a class action involving the 6.0 liter diesel engine, plaintiffs sued Ford. The jury found in favor of plaintiffs on their causes of action pursuant to the Song-Beverly Consumer Warranty Act (popularly known as the “lemon law”), the Consumers Legal Remedies Act (CLRA), and their fraud in the inducement–concealment cause of action. The jury awarded plaintiffs $47,715.60 in actual damages, which was the original purchase price of the truck, $30,000 in statutory civil penalties under the Song-Beverly Act, and $150,000 in punitive damages. The trial court granted plaintiffs’ motion for attorney fees in the amount of $643,615. Ford appealed, but finding no reversible error in the judgment and damages awards, the Court of Appeal affirmed. View "Anderson v. Ford Motor Co." on Justia Law
Melendez v. Westlake Services, Inc.
Melendez purchased a used 2015 Toyota from Southgate under a retail installment sales contract. Southgate assigned the contract to Westlake. Weeks later, Melendez sent a notice alleging Southgate violated the Consumer Legal Remedies Act (CLRA) and demanded rescission, restitution, and an injunction. Melendez later sued Southgate and Westlake, alleging violations of the CLRA, the Song-Beverly Consumer Warranty Act, Civil Code 1632 (requiring translation of contracts negotiated primarily in Spanish), the unfair competition law, fraud, and negligent misrepresentation. Westlake assigned the contract back to Southgate. Default was entered against Southgate. Westlake agreed to pay $6,204.68 ($2,500 down payment and $3,704.68 Melendez paid in monthly payments). Melendez would have no further obligations under the contract.The parties agreed Melendez could seek attorney fees, costs, expenses, and prejudgment interest. Westlake was entitled to assert all available defenses, “including the defense that no fees at all should be awarded against it as a Holder” The FTC’s “holder rule” makes the holder of a consumer credit contract subject to all claims the debtor could assert against the seller of the goods or services but caps the debtor’s recovery from the holder to the amount paid by the debtor under the contract. The trial court awarded attorney fees ($115,987.50), prejudgment interest ($2,956.62), and costs ($14,295.63) jointly and severally against Westlake, Southgate, and other defendants. The court of appeal affirmed. The limitation does not preclude the recovery of attorney fees, costs, nonstatutory costs, or prejudgment interest. View "Melendez v. Duff v. Jaguar Land Rover North America, LLC
Plaintiff-respondent Ken Duff prevailed at a bench trial on one claim under the Song-Beverly Consumer Warranty Act, but was only awarded $1 in nominal damages. The trial court awarded Duff $684,250 in attorney fees. Defendant-appellant Jaguar Land Rover North America, LLC (Jaguar) appealed the order awarding Duff attorney fees, arguing (among other things) Jaguar contended the trial court applied the incorrect legal standard in finding that Duff was the prevailing buyer under California Civil Code section 1794(d). The Court of Appeal agreed and thus, reversed the order and remanded the matter to the superior court to reconsider the issue. View "Duff v. Jaguar Land Rover North America, LLC" on Justia Law
Sellers v. JustAnswer LLC
JustAnswer LLC (JustAnswer) appealed an order denying its petition to compel arbitration. Tina Sellers and Erin O’Grady (together, Plaintiffs) used the JustAnswer website to submit a single question to an “expert” for what they believed would be a one-time fee of $5, but JustAnswer automatically enrolled them in a costlier monthly membership. After discovering additional charges to their credit cards, Plaintiffs filed a class action lawsuit against JustAnswer, alleging it routinely enrolled online consumers like them in automatic renewal membership programs without providing “clear and conspicuous” disclosures and obtaining their “affirmative consent” as mandated by the California Automatic Renewal Law. Seeking to avoid the class action litigation, JustAnswer filed a petition to compel individual arbitration, claiming Plaintiffs agreed to their “Terms of Service,” which included a class action waiver and a binding arbitration clause, when they entered their payment information on the website and clicked a button that read, “Start my trial.” In a case of first impression under California law, the Court of Appeal considered whether, and under what circumstances, a “sign-in wrap” agreement was valid and enforceable. The Court concluded the notices on the “Start my trial” screens of the JustAnswer website were not sufficiently conspicuous to bind Plaintiffs, because they were less conspicuous than the statutory notice requirements, and they were not sufficiently conspicuous under other criteria courts have considered in determining whether a hyperlinked notice to terms of services was sufficient to put a user on inquiry notice of an arbitration agreement. BBBB Bonding Corp. v. Caldwell
Caldwell signed an agreement to obtain a bail bond for her friend and was unable to pay the premiums. BBBB began collection efforts. Caldwell filed a putative class action. The trial court enjoined BBBB from enforcing bail bond premium financing agreements entered into by Caldwell and other similarly situated persons who had cosigned on behalf of an arrestee without having first been provided with notice under Civil Code 1799.91: if a creditor obtains the signature of more than one person on a consumer credit contract, and the signatories are not married, the creditor must provide the cosigner with a specified cosigner notice describing the financial risks of the transaction.The court of appeal affirmed, rejecting BBBB’s argument that because the Legislature adopted a comprehensive scheme to regulate the conduct of bail bond licensees, it intended to exclude from such transactions the consumer protections applicable to consumer credit contracts. A bail bond premium financing agreement between a cosigner and the bail bond agent is a consumer credit contract subject to the notice provision of section 1799.91 and related statutory protections. While acknowledging that it decision may upend business expectations for bail bond agents, the court declined to apply the injunction only on a prospective basis. View "BBBB Bonding Corp. v.
