The Taranto Group contracted with two outside vendors to send out advertising via facsimile transmissions on its behalf. It was later calculated that at least 5,000 transmissions were made in violation of the Telephone Consumer Protection Act (TCPA). A doctor brought an action individually and as a class representative against the Taranto Group, seeking damages and injunction relief under the TCPA and tort damages for conversion. A professional corporation then sought to intervene as an additional class representative. The district court issued an order certifying the proposed class and, in an amended order, certified the order for interlocutory appeal. The Supreme Court affirmed the district court's determination that class certification was appropriate in this case, holding, among other things, that the district court (1) correctly found the plaintiffs met their burden of demonstrating that they met the statutory requirements for class certification, (2) properly determined that a class action in this case was superior to individual small claims actions, and (3) properly concluded that a class action would avoid inconsistent adjudications.

Appellants Thomas and Robin Branhan borrowed money from Appellee Great Western Bank. As collateral for the loan, the Branhans gave Great Western a security interest in their shares of Glacial Lakes stock. The Branhans later defaulted on their loan. Great Western subsequently brought a foreclosure action against the Branhans. As part of a settlement agreement, the Branhans agreed to surrender and transfer to Great Western all their rights to Glacial Lakes stock they were unable to sell by a certain date. After Great Western issued a satisfaction of judgment, Glacial Lakes announced a capital call repayment. In response, the Branhans filed a motion to determine which party was entitled to the capital call repayments. The circuit court concluded that Great Western owned the stock and was therefore entitled to the repayments. The Supreme Court affirmed, concluding that Great Western was entitled to the capital call repayment because the benefit of capital call repayment transferred with the shares.

Petitioner William Daane defaulted on a loan secured by a mortgage on his residence. CR Title Services, the trustee of the deed of trust, filed a notice of default to initiate the foreclosure process. Daane opted to participate in the Foreclosure Mediation Program (Program). The district court later found that CitiMortgage, the beneficiary of the deed of trust, had participated in the mediation in bad faith. After the foreclosure process was reinitiated, Daane again elected for mediation in the Program. Daane subsequently brought a petition for a writ of prohibition, seeking to preclude the Program from proceeding with further mediations or issuing a letter of certification. The Supreme Court denied the writ, holding that a writ of prohibition was unwarranted to preclude the Program from conducting further proceedings with respect to Daane's residence because he had an adequate remedy in the ordinary course of law.

Plaintiffs, representing a putative class of purchasers of contact lens solutions, appealed the district court's order granting summary judgment for defendant. Plaintiffs brought suit alleging that defendant violated California's Unfair Competition Law (UCL), Cal. Bus. & Prof. Code 17200 et seq., and False Advertising Law (FAL), Cal. Bus. & Prof. Code 17500 et seq., by marketing Complete MoisturePlus as a product that cleaned and disinfected lenses. The district court ruled that plaintiffs lacked standing. Defendant argued that the ruling was not in error and that even if it was, the suit was properly dismissed because the class' claims were preempted by 21 U.S.C. 360k(a) of the Medical Devices Amendments of 1976 (MDA), 21 U.S.C. 360(c) et seq. The court held that the district court was incorrect to conclude that this class of plaintiffs lacked standing where they had demonstrated economic harm, but the court held that it could affirm the district court's summary judgment on any ground supported by the record. Therefore, the court held that the record demonstrated that the class' claims were preempted, so the court affirmed the grant of summary judgment.

Plaintiffs, citizens of Illinois, brought a class action on behalf of licensed drivers in several states against West Publishing, asserting claims under the Driver’' Privacy Protection Act, 18 U.S.C. 2722. They contend that West acquires personal information contained in motor vehicle records of millions of drivers, directly or indirectly, from state DMVs for resale in violation of the Act. The district court dismissed for lack of standing. The Seventh Circuit affirmed.While the Act does create a federal private right of action for people who claim that their personal information has been disclosed in violation of the Act, it does not prohibit West Publishing from reselling the plaintiffs' personal information to those with uses permitted by the Act.

American Suzuki Motor Corporation petitioned the Supreme Court for a writ of mandamus to direct the circuit court to grant its motion to dismiss the claims filed against it by John Burns and Jill S. Hearn. Plaintiffs sued Defendants American Suzuki, several local dealerships and the dealerships' owner, alleging breach of contract based on Suzuki vehicle warranties, diminution in value of their vehicles, fraudulent misrepresentations, and unjust enrichment. Plaintiffs purported to bring the action on behalf of themselves and all members of a class composed of individuals who had purchased Suzuki vehicles from Defendants and had active warranties or service contracts on those vehicles. According to the complaint, new Suzuki vehicles carried a manufacturer's warranty, and that Defendants also sold purchasers of Suzuki vehicles extended warranties and maintenance agreements. In early March 2009, "the defendants closed dealerships … and [that] there are no other Suzuki dealerships closer than Nashville, Tennessee, Murfreesboro, Tennessee, or Birmingham, Alabama, to perform service work on the warranted vehicles." As a result of the dealerships being closed, Plaintiffs alleged they were "constructively barred from obtaining warranty work on their vehicles." The complaint did not allege that Plaintiffs needed or sought service under the warranties on their vehicles or that any of the Defendants refused to honor the warranties on vehicles. American Suzuki filed a motion to dismiss alleging that Plaintiffs' claims should be dismissed for failing to state a claim upon which relief can be granted. Upon review, the Supreme Court reversed the trial court's denial of American Suzuki's motion to dismiss, and remanded the case to the trial court to enter an order granting American Suzuki's motion.

Appellant appealed the district court's decision, on summary judgment, that letters sent by appellant to nearly 40,000 California residents constituted "false, deceptive, or misleading representation[s]... in connection with the collection of any debt" in violation of the federal Fair Debt Collection Practices Act (FDCPA), 15 U.S.C. 1692e. Appellant also appealed the jury's award of statutory damages under both the FDCPA and California's Rosenthal Fair Debt Collection Practices Act (Rosenthal Act), California Civil Code 1788, et seq. The court held that the letters, which misleadingly implied that appellant had the ability to report obsolete debts to credit bureaus, and impliedly threatened to make such reports, violated section 1692e(5) and e(10) of the FDCPA. The court recognized that the FDCPA did not pre-empt consistent state action, including cumulative recovery of statutory damages under state law. The court also held that the Rosenthal Act's remedies were cumulative, and available even when the FDCPA afforded relief. Accordingly, the court affirmed the district court.

Appellants appealed the district court's order denying their Rule 60(b) motion for the district court to reconsider its previous order remanding the case to state court. In support of their motion, appellants claimed that, in light of a recent opinion issued by this court clarifying the method for calculating the amount-in-controversy requirement for subject matter jurisdiction, the district court had jurisdiction over the case. The district court denied the motion to reconsider because the case had been remanded to state court and was no longer pending in federal court. The court agreed and affirmed the denial of appellants' Rule 60(b) motion.

Plaintiffs, individual homeowners, sued defendants, some of the nation's largest housing developers, seeking damages, attorneys fees and costs, and the option to rescind their home purchases due to defendants' fraud, negligent misrepresentation, breach of implied covenant of good faith and fair dealing, and violations of California law. At issue was whether plaintiffs, who purchased homes in new developments, had standing to sue defendants for injuries allegedly caused by defendants' practice of marketing neighboring homes to individuals who presented a high risk of foreclosure and abandonment of their homes, financing those high-risk buyers, concealing that information, and misrepresenting the character of the neighborhoods. The court held that the district court erred in dismissing plaintiffs' overpayment and rescission claims for lack of Article III standing. The court also held that plaintiffs' decreased economic value and desirability were cognizable injuries. While the court agreed with the district court that, on the current record, plaintiffs have not established a sufficient causal connection between any decreased value and desirability and defendants' actions, plaintiffs should be permitted to amend their complaint and attach expert testimony on causation. Accordingly, the court reversed and remanded for further proceedings.

Frederick and Mandelena Harmon bought a home pursuant to a buy-sell agreement that realtor Dianne Burright, a licensed real estate salesperson who worked for Fiscus Realty, prepared at the Fiscus Realty office. The home was built by Dianne's husband, Jerry. The Harmons subsequently discovered numerous construction problems. The Harmons sued Defendants Jerry and Dianne Burright and Fiscus Reality, raising several causing of action, including a claim under the Unfair Trade Practices and Consumer Protection Act (the Act). A jury returned a verdict against the Burrights on breach of warranty and negligent misrepresentation claims and held for Defendants on all other claims. After trial, Defendants filed motions for attorney fees as prevailing parties under the Act, which the district court denied. Fiscus Realty appealed. The Supreme Court affirmed, holding that the district court did not abuse its discretion in denying an award of attorney fees to Fiscus Realty as the Harmons' claims had a basis in fact and law and were not frivolous, unreasonable or unfounded.
