Acuity operates a website that connects people looking to buy or sell homes with a local real estate agent. Acuity’s services are free to home buyers and sellers but realtors pay a fee for referrals. The real-estate broker that employed Lewis, a real estate agent, signed up to receive Acuity’s referrals. The broker required its agents (including Lewis) to pay Acuity’s fee out of their commissions from home sales. Lewis sued, alleging that Acuity makes false claims to home buyers and sellers on its website and that this false advertising violates the Lanham Act, 15 U.S.C. 1125(a)(1)(B).The Sixth Circuit affirmed the dismissal of the suit. The Lanham Act provides a cause of action only for businesses that suffer commercial injuries (such as lost product sales) from the challenged false advertising. The Act does not provide a cause of action for customers who suffer consumer injuries (such as the cost of a defective product) from false advertising. Lewis alleges that type of consumer harm as his injury from Acuity’s allegedly false advertising: He seeks to recover the referral fee (that is, the price) he paid for Acuity’s services. The Investigative Consumer Reporting Agencies Act (ICRAA, Civil Code, 1786) mandates certain disclosures for investigative consumer reports, which are often used by landlords to make decisions regarding consumers who apply for housing. ICRAA requires the adoption of “reasonable procedures” for providing consumer information “in a manner which is fair and equitable to the consumer," concerning the confidentiality, accuracy, relevancy, and proper utilization of their information. Any investigative consumer reporting agency or user of information that fails to comply with the requirements is liable to the affected consumer for any actual damages or $10,000, whichever sum is greater. Courts of appeal disagreed about the constitutionality and enforceability of ICRAA.In 2018, the California Supreme Court upheld the constitutional validity of ICRAA. Bernuy had filed one of 27 consolidated actions seeking damages against BPMC for its commission of ICRAA violations in 2017. Bernuy’s action was designated a “bellwether” case for adjudicating certain issues. The court of appeal held that the California Supreme Court’s 2018 decision did not constitute a subsequent change in the law that relieved BPMC of liability for its ICRAA violations. However, certain plaintiffs’ ICRAA claims are time-barred under the applicable two-year statute of limitations. The limitations period was not tolled by the pendency of a putative class action. In 2018, Appellant Nationwide Affinity Insurance Company of America (Nationwide) issued a personal automobile insurance policy to Shameika Clark, Respondent Andrew Green's mother. The policy included $25,000 in UIM property damage coverage for Clark and her family members. The general definition section broadly defined "property damage" as "physical injury to, destruction of[,] or loss of use of tangible property." The UIM endorsement, however, more narrowly defined "property damage" as "injury to or destruction of 'your covered auto.'" In October 2018, Green was hit by a vehicle while walking home from school. Green pursued a claim against Nationwide for UIM bodily injury, but Nationwide refused to pay because the accident did not result in “damage to a “covered auto.” Nationwide filed this declaratory judgment action and requested a declaration that Green was not entitled to UIM property damage. The circuit court reformed Nationwide’s policy rider issued to Clark, finding that under South Carolina case law, insurers could not limit that coverage to vehicles defined in policy as “covered autos.” The South Carolina Supreme Court affirmed the circuit court’s judgment. Minnesota sued a litany of fossil fuel producers1 (together, the Energy Companies) in state court for common law fraud and violations of Minnesota’s consumer protection statutes. In doing so, it joined the growing list of states and municipalities trying to hold fossil fuel producers responsible for alleged misrepresentations about the effects fossil fuels have had on the environment. The Energy Companies removed to federal court. The district court granted Minnesota’s motion to remand, and the Energy Companies appealed.   The Eighth Circuit affirmed. The court held that Congress has not acted to displace the state-law claims, and federal common law does not supply a substitute cause of action, the state-law claims are not completely preempted. The court reasoned that because the “necessarily raised” element is not satisfied, the Grable exception to the well-pleaded complaint rule does not apply to Minnesota’s claims. Further, the court wrote that the connection between the Energy Companies’ marketing activities and their OCS operations is even more attenuated. Ward twice received medical treatment at Stonecrest after signing agreements, stating that Ward was responsible for charges not covered by insurance and that Stonecrest may “utilize the services of a third party" as an extended business office (EBO) for billing and account servicing, and that while the account is being serviced by the EBO it is not considered delinquent, past due or in default. Stonecrest would “determine the account to be delinquent, past due, and in default” after its return from the EBO and the account could be referred to a collection agency. After Ward did not pay bills from Stonecrest, Ward’s accounts were referred to a third party, NPAS, which mailed Ward statements and left him messages. NPAS identified itself as “a company that is managing your account." Ward contacted a law firm, which erroneously sent a cease-and-desist letter to the wrong company.Ward sued under the Fair Debt Collection Practices Act (FDCPA), alleging NPAS had not disclosed its identity as a debt collector, 15 U.S.C. 1692d(6); used a name other than its “true name” (NPAS instead of NPAS, Inc.); and called him after he attempted to send a cease-and-desist letter. The court held that NPAS did not qualify as a “debt collector” under the FDCPA. The Third Circuit found that Ward did not have Article III standing but remanded. On remand, Ward amended his complaint and submitted documents to show he had suffered concrete harm. The Third Circuit affirmed that those changes were sufficient to demonstrate Ward’s standing but that NPAS is not a debt collector. View "sWard v. NPAS, Inc." on Justia Law

The Supreme Court affirmed in part, reversed in part and vacated in part the judgment of the circuit court holding that Bristol-Myers Squibb and Sanofi had violated Hawai'i's Unfair or Deceptive Acts or Practices law (UDAP) by misleading the public about the safety and efficacy of their anitplatelet drug, Plavix, holding that remand was required.The circuit court concluded that Defendants misled Hawai'i consumers by failing to warn them that Plavix was less effective for poor responders, granted the State's motion for partial summary judgment, and imposed an $834 million penalty. The Supreme Court (1) reversed the circuit court's deceptive acts or practices holding, holding that the summary judgment ruling circumscribed Defendants' ability to present a full defense and affected the penalty award, requiring a new trial; (2) affirmed the holding that Defendants committed unfair acts under UDAP; and (3) held that Defendants' procedural arguments failed. A putative class of over 12 million merchants brought this antitrust action under the Sherman Act against Visa U.S.A. Inc., MasterCard International Inc., and numerous banks that serve as payment-card issuers for those networks. Plaintiffs alleged that Visa and MasterCard adopted and enforced rules and practices relating to payment cards that had the combined effect of injuring merchants by allowing Visa and MasterCard to charge supracompetitive fees (known as “interchange fees”) on each payment card transaction. After nearly fifteen years of litigation, the parties agreed to a settlement of roughly $ 5.6 billion, which was approved by the district court over numerous objections. In so doing, $900,000 in service awards was granted to lead plaintiffs, and roughly $523 million was granted in attorneys’ fees. Appellants are various objectors who argue that the district court erred when it certified the class, approved the settlement, granted service awards and computed attorneys’ fees.   The Second Circuit affirmed in all respects the district court’s orders to the extent they constituted a final judgment, with the exception that the court directed the district court to reduce the service award to class representatives to the extent that its size was increased by time spent in lobbying efforts that would not increase the recovery of damages. The court made no ruling as to how damages should be allocated between branded oil companies and their branded service station franchisees, the reasonableness of the special master’s ultimate findings, or the legality of releasing an as-of-yet hypothetical future claim. Federal Rule of Civil Procedure 60(b) authorizes relief from a final judgment, order, or proceeding based on, among other things, “fraud on the court.” Years after an adverse judgment and unsuccessful appeals in Mazzei v. The Money Store, 829 F.3d 260 (2d Cir. 2016) (“Mazzei I”), Plaintiff sought such relief in district court. He did so after a deposition in a separate, unrelated lawsuit cast doubt on the truthfulness of certain representations that Defendants’ counsel made to the court in Mazzei I. Defendants moved under Rule 12(b)(6) to dismiss the fraud on the court claim, which the district court granted. Plaintiff then moved for reconsideration, which was denied. Plaintiff then appealed these orders.   The Second Circuit affirmed. The court held that the district court correctly concluded that Plaintiff failed plausibly to plead a fraud on the court claim. The district court correctly reasoned that the conduct of which he complained had not impaired the court’s ability to fully and fairly adjudicate his case because the fraud alleged could have been redressed in Mazzei I. Defendant LuLaRoe, a multilevel-marketing company that sells clothing to purchasers across the United States through “fashion retailers” located in all fifty states, allegedly charged sales tax to these purchasers based on the location of the retailer rather than the location of the purchaser. LuLaRoe eventually refunded all the improper sales tax it collected, but it did not pay interest on the refunded amounts. Plaintiff, an Alaska resident who paid the improperly charged sales tax to LuLaRoe, brought this class action under Alaska law on behalf of herself and other Alaskans who were improperly charged, for recovery of the interest on the now-refunded amounts collected and for recovery of statutory damages. The district court certified the class under Rule 23(b)(3) and LuLaRoe appealed under Rule 23(f).   The Ninth Circuit vacated the district court’s order certifying the class of Alaska purchasers and remanded for further proceedings. The panel first rejected LuLaRoe’s argument that class certification was improper because the small amount of money currently owed to some class members was insufficient to support standing and the presence of these class members in the class made individualized issues predominant over class issues. The panel next rejected LuLaRoe’s assertion that some purchasers knew that the sales tax charge was improper but nevertheless voluntarily paid the invoice which contained the improperly assessed sales tax amount, and thus, under applicable Alaska law, no deceptive practice caused any injury for these purchasers. Finally, the panel held that LuLaRoe’s third argument, that class certification should be reversed because some fashion retailers offset the improper sales tax through individual discounts, had merit. The Federal Communications Commission (“FCC”) has long monitored local telephone companies’ “access stimulation.” In 2011, the FCC issued rules to address this phenomenon, defining when carriers engage in access stimulation and restricting the rates that they could charge. After local carriers found loopholes in this regulatory system, the FCC revisited and updated these rules, issuing the Updating the Intercarrier Compensation Regime to Eliminate Access Arbitrage (“Access Arbitrage Order”), 34 FCC Rcd. 9035 (2019). Wide Voice, LLC (“Wide Voice”), rearranged its business model and call traffic path in coordination with closely related entities, HD Carrier and Free Conferencing. Wide Voice petitions for review of the FCC’s order, specifically arguing that the FCC unreasonably concluded that it violated Section 201(b) by restructuring its business operations to continue imposing charges that were otherwise prohibited.   The Ninth Circuit denied the petition for review. The panel held that the FCC properly exercised its authority under § 201(b) to hold Wide Voice liable for circumventing its newly adopted rule in the Access Arbitrage Order when the company devised a workaround. Contrary to Wide Voice’s assertions, the FCC need not establish new rules prohibiting the evasion of its existing rules to find a Section 201(b) violation. The panel rejected Wide Voice’s contention that it restructured its business to comply with, rather than evade, the FCC’s new rules. Finally, the panel rejected Wide Voice’s contention that even if the FCC was permitted to find its conduct “unjust and unreasonable,” it did not have fair notice that its practices were unlawful, and therefore the FCC violated its right to due process.
