Plaintiff filed a class action complaint alleging that 5 Star negligently, willfully, and/or knowingly sent text messages to his cell phone number using an automatic telephone dialing system without prior express consent in violation of the Telephone Consumer Protection Act (TCPA). The district court dismissed the complaint for lack of standing.The Fifth Circuit reversed, concluding that plaintiff has alleged a cognizable injury in fact: nuisance arising out of an unsolicited text advertisement. The court concluded that the TCPA cannot be read to regulate unsolicited telemarketing only when it affects the home. The court also concluded that plaintiff's injury has a close relationship to common law public nuisance and, moreover, plaintiff alleges a special harm not suffered by the public at large. The court rejected the Eleventh Circuit's holding in Salcedo v. Hanna, 936 F.3d 1162, 1168 n.6 (11th Cir. 2019), and remanded for further proceedings. Reck purchased a new car manufactured by FCA, experienced frequent issues with the vehicle, and unsuccessfully requested its repurchase. Reck sued under the Song-Beverly Consumer Warranty Act, Civ. Code, 1790 After discovery, FCA served Reck with a second Civil Code section 998 offer, proposing to settle the matter for $81,000 plus costs, expenses, and attorney fees. Their counsel, Knight, had incurred $15,000 in legal fees. The Recks rejected the offer. Two days after trial commenced, the case settled for $89,500 plus fees and costs to be determined separately.Counsel sought attorney fees under section 1794(d): $46,487.50 in services provided by Knight and $78,344 in legal services provided by Century Law. FCA objected, arguing that the Recks incurred approximately $100,000 in attorney fees between April 2018, when the $81,000 settlement offer was refused, and August 2018, when they agreed to settle; that adding a second law firm to try the case resulted in unnecessary duplication of effort; and that three of their motions had been denied or withdrawn. The trial court found the case “not particularly complex” and awarded $20,158 in attorney fees with a requested .5 multiplier, finding that the $8,500 difference did not justify an award of fees for any hours spent preparing for trial.The court of appeal reversed. The Song-Beverly Act mandates the recovery of reasonable attorney fees to a prevailing plaintiff based upon “actual time expended.” The trial court did not undertake a lodestar analysis of fees reasonably incurred following the rejection of the settlement offer. In the context of public interest litigation with a mandatory fee-shifting statute, it is an error of law for the court to categorically deny or reduce an attorney fee award on the basis of a plaintiff’s failure to settle when the ultimate recovery exceeds the section 998 settlement offer. Stafford used his third-party insurance coverage to purchase prescription drugs from Rite Aid’s pharmacies. Rite Aid submits a claim for a prescription drug to an insurance company through a “pharmacy benefits manager” (PBM). The claim form that Rite Aid submits includes the “usual and customary” price of the relevant prescription drug.Stafford brought a class action, alleging that Rite Aid fraudulently inflated the reported prices of prescription drugs, which resulted in class members paying Rite Aid a higher co-payment for the drugs than they would have paid if Rite Aid had reported the correct price. After litigating several motions to dismiss, Rite Aid moved to compel arbitration. Although Rite Aid and Stafford had no contract between them containing an arbitration clause, Rite Aid did have such contracts with the PBMs who coordinated insurance reimbursements and co-payment calculations.The Ninth Circuit affirmed the denial of the motion to compel arbitration. Under California law, Stafford’s claims did not depend on Rite Aid’s contractual obligations to the PBMs. Consequently, equitable estoppel did not apply to bind Stafford to the arbitration agreements in those contracts. TitleMax of Georgia, Inc., and its parent company, TMX Finance LLC ("TMX"), petitioned the Alabama Supreme Court for a writ of mandamus to direct the Talladega Circuit Court to vacate its order denying their motion to dismiss them as parties to the underlying action commenced against them and others by Phallon Billingsley and to enter an order dismissing them from the action based on the trial court's lack of personal jurisdiction over them. This case started over the repossession of a 2005 Range Rover. In December 2014, the individual who owned the vehicle at that time allegedly entered into a "pawn ticket" agreement with TitleMax of Georgia pursuant to which the owner borrowed money from TitleMax of Georgia and provided TitleMax of Georgia a security interest in the vehicle. In 2016, Billingsley purchased the vehicle from a dealer in Georgia, with financing from Coosa Pines Federal Credit Union ("Coosa Credit"), and received a certificate of good title. In 2014, after a "perceived" default on the "pawn ticket" agreement by the vehicle owner, TitleMax of Georgia authorized a vehicle-repossession company to take possession of the vehicle when it was located in Virginia in 2019. TitleMax of Georgia asked Insurance Auto Auctions Corp. ("IAA") to sell the vehicle; when the vehicle ultimately reached Billingsley, it was damages and inoperable. It was unclear when the damage to the vehicle occurred. Billingsley sued all entities involved in the sale and delivery of the repossessed vehicle; TitleMax of Georgia was added as a party in an amended complaint. The Alabama Supreme Court granted TitleMax of Georgia’s petition, finding there was no evidence to support a finding that an agency relationship existed between either TitleMax of Georgia or TMX and IAA or Attention to Detail (the transport company). Sekura purchased a membership from Krishna that gave her access to L.A. Tan’s salons. Her membership required Sekura to provide Krishna with her fingerprints. Sekura filed a class-action lawsuit against Krishna, alleging that Krishna violated the Biometric Information Privacy Act: because it “systematically and automatically collected, used, stored, and disclosed their [customers’] biometric identifiers or biometric information without first obtaining the written release required by 740 ILCS 14/15(b)(3) … systematically disclosed ... biometric identifiers and biometric information to SunLync, an out-of-state … vendor and … does not provide a publicly available retention schedule or guidelines for permanently destroying its customers’ biometric identifiers and biometric information as specified by the [Act].” The complaint also alleged negligence and unjust enrichment. Krishna tendered Sekura’s lawsuit to West Bend, its insurer.West Bend sought a declaratory judgment that it did not owe a duty to defend Krishna against Sekura’s lawsuit. The trial court entered a judgment for Krishna. The appellate court and Illinois Supreme Court affirmed after construing the policy terms “personal injury or advertising injury,” “publication” of material, and violation of Sekura’s “right of privacy” to conclude that the allegations in Sekura’s complaint fall within or potentially within West Bend’s policies’ coverage for personal injury or advertising injury. The Eighth Circuit affirmed the district court's dismissal of plaintiff's action against numerous companies for violating the Missouri Merchandising Practices Act (MMPA) through their marketing of men's and women's antiperspirants. Plaintiff alleges that Conopco, Inc.—doing business as Unilever—discriminates based on gender in pricing two Dove product lines.The court concluded that plaintiff mistakes gender-based marketing for gender discrimination where she ignores the fact that the different scents, packaging, and labels make the products potentially attractive to different customers with different preferences. The Supreme Court affirmed the judgment of the district court setting aside an investigative subpoena served by the Consumer Protection Unit of the Wyoming Office of Attorney General, holding that there was no error or abuse of discretion.WyoLaw, LLC filed this petition to set aside the Attorney General's subpoena, claiming that it was not subject to the Attorney General's investigative authority, that the Attorney General lacked probable cause to support its subpoena, and that the documents were protected by the work product doctrine and the attorney client privilege. The district court denied the request to modify or set aside the subpoena and ordered WyoLaw to produce the documents. The Ninth Circuit filed an order (1) amending its December 29, 2020, opinion issued on remand from the United States Supreme Court; and (2) denying on behalf of the court a sua sponte request for rehearing en banc. The panel reaffirmed the district court's order granting the CFPB's petition to enforce Seila Law LLC's compliance with the Bureau's civil investigative demand (CID) requiring the firm to produce documents and answer interrogatories. The amendments reflected that two of the panel's citations were to the plurality portion of the Supreme Court opinion.The panel held that the CID was validly ratified, but that there was no need to decide whether the ratification occurred through the actions of Acting Director Mulvaney. After the Supreme Court's ruling, the CFPB's current Director, Kathleen Kraninger, expressly ratified the agency's earlier decisions. Furthermore, at the time that she ratified these decisions, Director Kraninger knew that the President could remove her with or without cause. Therefore, the ratification remedied any constitutional injury that Seila Law may have suffered due to the manner in which the CFPB was originally structured. Seila Law advances two arguments challenging the validity of Director Kraninger's ratification, neither of which the panel found persuasive. Medicredit sent Markakos a letter seeking to collect $1,830.56 on behalf of a creditor identified as “Northwest Community 2NDS” for medical services. Markakos’s lawyer sent Medicredit a letter disputing the debt (because the medical services were allegedly inadequate). Medicredit then sent a response that listed a different amount owed: $407.00. Markakos sued Medicredit for allegedly violating the Fair Debt Collection Practices Act, 15 U.S.C. 1692g(a)(1)–(2), by sending letters to her that stated inconsistent debt amounts and that unclearly identified her creditor as “Northwest Community 2NDS”—which is not the name of any legal entity in Illinois.The Seventh Circuit affirmed the dismissal of the case without prejudice. Markakos lacks standing to sue Medicredit under the Act because she did not allege that the deficient information harmed her in any way. She admits that she properly disputed her debt and never overpaid. Markakos’s only other alleged injury is that she was confused and aggravated by Medicredit’s letter. Winning or losing this suit would not change Markakos’s prospects; if Markakos lost, she would continue disputing her debt based on the inadequacy of the services and if she won, she would do the same. The Second Circuit affirmed the district court's grant of summary judgment in favor of Lands' End in a putative class action brought by Gorss Motels under the Telephone Consumer Protection Act (TCPA), seeking compensation for faxes it received advertising the products of Lands' End.As a preliminary matter, although the parties do not raise the issue on appeal, the court concluded that Gorss has standing to proceed under the TCPA. The court concluded that Gorss gave prior express permission to receive the faxes at issue through its franchise agreements with Wyndham, and rejected plaintiff's contention that any permission to send fax advertisements was given to Wyndham and not to Lands' End. Therefore, the court concluded that Gorss agreed to the process that occurred here, in which Wyndham sent Gorss fax advertisements on behalf of a Wyndham approved supplier, Lands' End, advertising products that could be used in franchised motels.
